On The Rocks Climbing Guides Ltd. ("On The Rocks") collects user information from users, including website visitors, subscribers, financial transactions, course registrants and participants, correspondants, contractors and other parties with whom On The Rocks interacts. By visiting the website or conducting correspondence or other means of sharing personal information with On The Rocks, you consent to our Privacy and Personal Information Policy.

 

This policy explains our approach to managing personal information, and to explain how and where this information may be shared or stored. It is not meant to supersede any legal rights or obligations.

2. Definitions

 

"On The Rocks" refers to On The Rocks Climbing Guides Ltd.

"Users" and "You" refer to users as defined above, and the reader as subject to this policy, respectively

 

3. What Personal Information do we collect?

 

On The Rocks collects personal information in relation to user subscriptions, course registrations, purchases and financial transactions, forms associated with gift card purchases or inquiries, participant and spectator waivers, contacts, and contractual relationships. On The Rocks may also collect information relating to courses, such as photographs or video recordings, course reports or incident reports, and participant emergency contact information.

 

This information may include visitor or customer behaviour history, names, birthdates and contact information, correspondence (including personal information disclosed by correspondent), feedback and survey responses, photographs and videos, contracts or other agreements and other similar documents.

 

On The Rocks does not sell user personal information to other parties for advertising purposes, nor does the company have access to credit card numbers or billing addresses of customers. 

 

4. Why is this information collected?

 

User information is collected for the purpose of guiding On The Rocks operations, conducting communications with users, to provide products and services to users and subscribers, to conduct and record financial transactions, for liability reasons, for the use of On The Rocks for promotional purposes, to maintain professional relationships, and for planning.

 

5. How is Personal Information shared, and with whom?

 

Personal Information may be shared with contracted guides, for the purpose of planning and providing services or products to registered or potential customers, and occasionally to other partners, such as land managers (eg. Conservation Halton). It is important that guides and other service providers (eg. Climbing gyms, land managers, etc.) receive this information to guide the provision of services, and for planning and billing purposes. Users should be aware that direct email, telephone and verbal communications with contractors (guides or others) may not be received or monitored by On The Rocks.

 

Personal information may be shared with Third Party Providers of services, including internet service providers, app companies or financial transaction processors. In particular, On The Rocks' website is hosted by Wix, communications and other data are stored and processed using Google Workspace, waivers are processed and stored by Smartwaiver, and financial transactions are processed by Stripe. This is important as each of these companies has its own data storage and privacy policies. 

 

Personal and financial transaction information (not including card numbers) may be shared with external contractors providing bookkeeping and accounting services, including receipts and/or invoices. This information is provided for the purposes of bookkeeping, and may be provided to the Canada Revenue Agency in the case of a valid request.

 

In the case of an emergency, On The Rocks will provide personal information to first responders or EMS, designated emergency contacts, law enforcement and insurance providers, as deemed necessary. On The Rocks (and potentially other parties named above) may provide personal information to law enforcement agencies upon receipt of what is deemed to be a legitimate request.

 

Photos and videos collected by On The Rocks during adventures, courses and clinics are considered property of On The Rocks, and as such, may be shared or used for promotional purposes without restriction. See Section 9 for information about requests relating to photos or videos.

 

6. Where is this information stored?

 

Information is stored digitally through data storage services provided by Wix, Apple, Stripe, Smartwaiver and Google Workspace. As such, this data may be stored outside of Canada or North America. On The Rocks does not claim to know or control the exact nature or location of this data storage. For more details, please refer the to privacy policies of the mentioned companies.

 

Photos and videos relating to On The Rocks adventures, courses and clinics are considered property of On The Rocks, and may be shared or stored in a variety of formats without restriction. See Section 9 for information about requests relating to photos or videos.

 

Physical records such as waivers or printed contracts and receipts may be filed and stored by the company within Canada for either 7 years or as deemed necessary for record keeping.

 

7. Use of cookies, etc.

 

While On The Rocks does not use cookies to provide targeted services or advertising, some cookies are employed in the function of the website, and to track visitor activity. Users wishing to block cookies or pop-ups may use their browser settings to do this, however this may impact  website functionality.

 

8. Communications and promotional material from On The Rocks

 

On The Rocks will maintain contact information and may issue occasional correspondence with contacts for as long as it deems there is a commercial or informational relationship with the contact. This may include promotional or other (eg. technical) information which On The Rocks believes may be of interest or importance to the recipient.

 

Should a contact or user wish to discontinue communications, or remove their name and contact information from a subscriber list, this can be done by emailing On The Rocks at info@ontherocksclimbing.com with the word "Unsubscribe" in the subject line or content of the message. 

 

9. Personal Information Requests and Concerns

 

If users have concerns about the storage or retention of personal information, they may request additional details by email at info@ontherocksclimbing.com or by mail at:

On The Rocks will do its best to identify any retained personal information, and is open to requests to remove contact information or correspondence, where not required for financial, legal, contractual or strategic records.

 

While photos and videos from On The Rocks adventures, courses and clinics are considered property of the company, On The Rocks is open to receiving requests to discontinue the use of certain images or likenesses. However, as these images may be widely published or shared, On The Rocks makes no warranty that the images may not continue to exist, or that they may not reappear in another format or location.

 

10. How long do we keep information?

 

Personal information is typically stored for as long as On The Rocks judges that the information is of potential importance to the client relationship, for financial or legal records or for strategic planning. However, On The Rocks attempts to delete or destroy records which are deemed of no further relevance, including older contact information, correspondence, and documents.

 

When users unsubscribe or otherwise request certain information be removed, On The Rocks will attempt to remove affected information or respond in a timely manner, and in no less than 30 days.

 

11. Updates

 

This policy is subject to periodic updates whenever relevant information or policies change. Users are advised to review it to ensure they are still in comfortable with the current policy.
